1. Who these terms are between
PERDIEM is the website at perdiem.tech, operated by Tsernskin keiys OÜ, a company registered in Estonia (registry code 17587191, registered office P. Kerese tn 17-20, 20309 Narva, Ida-Viru maakond, Estonia).
These terms are between Tsernskin keiys OÜ and you, the person who opens an account. "We" and "us" mean Tsernskin keiys OÜ. "You" means you, the organiser.
PERDIEM is sold to individuals and to businesses. A business may buy eSIMs for the people it sends travelling, or for an employee's family on a trip. If you open an account or buy on behalf of a business, you confirm that you have the authority to bind that business to these terms, and "you" then also means the business. Where a business buys, the consumer rights in these terms that the law gives only to consumers do not apply to it.
eSIMs and credit are for the use of your family, or of the travellers your business buys for. They may not be resold.
2. Who can open an account
You must be at least 18 years old. PERDIEM is not available in Russia, Belarus, Iran, North Korea, Syria or Cuba: you may not open an account if you live there, we do not sell eSIMs for use there, the site is not served to visitors from those countries, and sign-up refuses email addresses hosted there.
You open the account for your own family, or for the travellers a business buys for, as its organiser. You are responsible for the account, for keeping your password safe, and for what is done with it.
3. What the service is
An eSIM is a SIM card with no plastic: a mobile data plan that a phone installs from a QR code or an activation code. We resell eSIM data plans issued by a connectivity provider.
Your account gives you a console where you keep a family pool of prepaid credit, add family members, set a spending limit for each of them, choose the countries they can use, and get a SIM for someone when they need one.
We are not a mobile network. Coverage, speed and network availability belong to the connectivity provider and the local operators, and we do not control them.
4. Your family members
You add the members of your family yourself. They may include children. For each member we keep only what you enter: a name, an email address if you choose to give one, their limit and the countries they can use, and the SIMs you get for them.
You are responsible for each member's use of a SIM you get for them, and for having their agreement, or a parent's authority, to enter their details. We never contact your family members. Everything happens through you.
5. The family pool
The family pool is prepaid credit. One credit is worth one euro (€1.00), and the pool balance is kept in credits. You add to it by Visa or Mastercard card payment in euros or in US dollars, whichever you choose, in a single payment of between €1 and €20,000 or the same amounts in US dollars, or by choosing a preset amount (25 credits, 50 credits, 150 credits). A payment in US dollars buys credit at that day's exchange rate, and the button shows the exact amount before you pay.
Card top-ups open at launch. Until then the top-up button in the console is disabled and says so, and nothing can be charged.
There is no subscription, no renewal, no stored card and no minimum term. Nothing is charged except a payment you make at the moment you make it. Credit in the pool does not expire.
The pool cannot go below zero. A request the pool does not cover is refused and nothing is taken.
6. Getting a SIM, and its price
Each plan costs the connectivity provider's price, converted into credits (euros), plus 225%, rounded to the nearest ten cents. The console shows the exact price before you confirm, and that is the amount taken from the pool.
Every price is shown in euros or US dollars, whichever you choose, and taken from the pool in credits. We convert the provider's US-dollar price at a rate we refresh at most once a day. The credit amount the console shows before you confirm is exactly what the pool is charged; a US-dollar figure is that amount at the day's rate.
When you confirm, the SIM is delivered in the console. Its page shows a QR code, the activation code and the ICCID (the SIM's serial number). You install it on your family member's phone, or share it with them. We do not send SIMs by email.
7. Limits, countries and refusals
Where you have set a spending limit for a member, or chosen the countries they can use, we refuse a request that would go over the limit or fall outside those countries. We also refuse a request for a paused member, or one the pool cannot cover. The console says which check stopped it.
A refused request charges nothing. Limits are yours to set, raise or remove, and a change takes effect straight away. We do not apply a limit you have not set.
8. When the provider fails
The price is taken from the pool before the connectivity provider is asked for the SIM, because that is the only way a limit can be held to. If the provider then fails to issue it, the full amount goes back into the pool automatically. You do not have to ask.
9. Your right to cancel
If you buy as a consumer, you normally have 14 days to withdraw from a purchase made online. A SIM is issued the moment you ask for it. By confirming, you ask us to issue it straight away, and you accept that the right to withdraw ends once the SIM has been installed or used.
A SIM that has never been installed can be returned on request within 14 days, where the connectivity provider allows it to be cancelled. Unused credit in the pool can be returned to your card on request. The refund policy explains both.
10. Pausing, closing and suspension
You can stop using the service at any time. You can pause a member, remove a member who never had a SIM, ask for your unused credit back, or close the account in the console. An account cannot be closed while the pool still holds credit, so that money is never lost by accident. The cancellation policy sets out each step.
We may suspend an account where we reasonably believe it is being used unlawfully, where a payment is reversed, or where these terms on age or residence are not met. We will tell you why.
11. What we are liable for
If we fail to provide what we promised, we are liable for loss that was a foreseeable result of that failure. We are not liable for loss that was not foreseeable. We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to exclude.
We do not promise a level of availability for the console, and we cannot guarantee the coverage or speed of the mobile networks a SIM connects to.
12. Changes to these terms
If we change these terms, the new version applies from the date shown at the top of this page. The version in force when you add money to the pool governs the SIMs you get with that money.
13. Law, complaints and disputes
These terms are governed by the law of the Republic of Estonia. Disputes are decided by Viru County Court (Viru Maakohus), Estonia. If you are a consumer living in another country, you keep the protection of the mandatory consumer law of the country you live in, and you may bring a claim in the courts there.
If something has gone wrong, write to support@perdiem.tech first and we will try to put it right. You can also contact your national consumer authority.
